Our bill just passed out of committee! The 4 foot passing distance was reinstated but attempts to put “far to right” were unsuccessful. The bill now goes to be reported out of committee on the floor of the full House and up for passage by wed next week. Our efforts now need to focus on the full house!

Gary,
Thanks for your guidance to the Com. Amendments. "This is part of the danger of opening the code to make things better – sometimes it can make things worse!" is one reason I resisted us pursuing legislation without first educating all relevant key stakeholders.
The fact that the very sponsors of the bill moved to amend it to reinstate the requirement that cyclists ride far to the right displays that they may not understand the dangers to cyclists of such a law. It also displays that they may not believe that cyclists have the same rights to the road as motorists but rather that bicyclists should get out of the way.

Our bill passed out of judiciary committee. Back to 4 foot passing requirement but attempt to add repeal of far to right failed.
Great work Gary Zuckett!
Yes, more to be done but again the dialogue and awareness/visibility of cycling issues has been incredible.
Thanks to all of you for making calls and sending emails.

Thanks, Gary. Can you send us the names and phone numbers of the Judiciary members? Beyond Judiciary what other hoops does the bill have to clear before it becomes law? Is there some place on line that we can see the changes to it as it proceeds?

Barbara,
Please repeal 17C-11-5 (a) that requires bicyclists to ride as far to the right as practicable.
Today, the Judiciary Committee will consider HB 3021. As introduced, HB 3021 repealed 17C-11-5 (a). The Transportation and Roads Committee amended HB 3021 and reinstated 17C-11-5 (a).
I've attached a one-page summary of the dangers that riding far to the right as required by 17C-11-5 (a) present to bicyclists. Basically, when cyclists ride too far right on narrow roads, motorists pass dangerously close; intrude into the on-coming lane when there is on-coming traffic; make right turns into cyclists at driveways and intersections; run into cyclists from behind when the cyclists turn left from the right side of the lane; turn left into on-coming cyclists that they don't see because they are screened by overtaking traffic and broken pavement, potholes, broken glass, debris and other hazards that are prevalent at the edge of the road cause bicyclists to crash.
The one-minute animation at http://commuteorlando.com/ontheroad/animations/narrowlane/narrowlane.html shows what happens when a cyclist rides too far right in narrow lanes.
I've also attached a detailed analysis that shows how 17C-11-5 (a) contradicts and confounds other laws. A fundamental issue underlying this and other such laws that discriminate against bicyclists is equal rights and justice for bicyclists, motorists and other road users.
I will call you to discuss this issue. If you would like to call me, my number is 304-376-0446.
Thanks for your continued support of bicyclists!

I feel we should move quickly in support of moving the bill in the house. We have two of three items - 3ft & side path intact. We can work to fix it in the Senate. The challenge for now is to get it passed out of Judiciary committe by tomorrow to keep it alive!

Hey guys,
Here's the plan! After looking at the Doodle poll, most folks are
available on *Friday from 10am-11am for the photo shoot at the Black Bear -
Evansdale*. Try to be prompt as the managers at Black Bear will need to
focus on their lunch rush hour as early as possible.
If possible, arrive on a *bike or bring bikes and wear cycling or
commuting-style clothing*. If you can't ride there, please try to bring a
bike or two in your car. If you can bring bikes, we still need you!
After we take the photo on Friday, Emily or I will upload to the Saris
Facebook page ASAP, and we'll *all need to be responsible for pushing our
friends/acquaintances for votes through Social Media, etc before the end of
the day Friday*.
Our photo will get uploaded here:
https://www.facebook.com/SarisCycleRacks?v=app_212049048919872&app_data=gaR…
I'll put that link over on these Google groups: Mon Bike Club, WVMBA, WVU
Cycling, or other pages you guys recommend.
I'm also going to try to make a flyer for the Black Bear folks to hang up
tomorrow to drive votes. As of today, the highest voted photo has 139
votes. I feel confident if we work hard, we can get that many in a day.
Let's give it a shot and hope our time is worth it! Not sure about you,
but I'd feel great getting yet another nice bike rack placed in our town at
one of our favorite restaurants!
If you have any questions, call me at 304-290-7727.
Thanks,
