H.B. 4304

Dear Judiciary Subcommittee Delegates, I understand that an exemption from H.B. 4304 has been requested for the Coalfields Expressway roads. Are the Coalfields Expressway roads exempt from the current 17C-7-3? If not, there's no reason to exempt them from the proposed amended 17C-7-3. They both require a vehicle to "...pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle". How do coal trucks pass farm tractors, school buses, highway maintenance equipment and other slow moving vehicles on the Coalfields Expressway Roads? Just run them over? Frank D. On Friday, January 24, 2014, House Bill 4304 was introduced to the WV legislature. H.B. 4304: * requires motorists to pass bicycles not less than three feet at a careful and reduced speed; * allows motorists to cross the double yellow line to pass a bicycle; * repeals the law that requires bicyclists to ride as far to the right as practicable; * repeals the requirement for bicyclists to use a side path and not to use the road; * repeals the requirement for bicycles to have a bell. Okay folks, This meeting needs to happen. And I need minutes/action items from the last meeting. I'm sure Jing will have some updates. Here's what I have so far for an agenda- ********** Welcome First Sergeant Matt McCabe our newest ex-officio member and ask him for his views on the BB and how to implement the enforcement part of the Bicycle Plan. Planned Enforcement Actions: 1. Establish and maintain a plan for traffic enforcement to improve bicycling safety and to reduce the perceived risk of bicycling in Morgantown. 2. Conduct an annual Enforcement for Bicycle Safety workshop with the Morgantown Police department. 3. Send rights and duties postcard to motorists that cyclists or others observed and reported violating bicyclist rights. 4. Handout rights and duties card along with citation to cyclists who violate rules of the road. 5. Cite bicyclists who run stop signs, ride against traffic, make improper turns or violate other laws. 6. Cite motorists for improper driving around cyclists with emphasis on failure to stop for stop signs, failure to yield at intersections and passing cyclists too closely and too fast. 7. Measure bicycle use, bicycle crashes, bicycle injuries, and bicycle-related citations and publish the results quarterly and yearly. Analyze data to identify opportunities for increasing bicycle use and reducing crashes. Every year, 2 months before the beginning of the City's annual budget cycle, conduct an annual review with City Council, Chief of Police, City Engineer and the Bicycle Board of trends in bicycle use, bicycle crashes, bicycle injuries and, bicycle-related citations and identify required changes to the Bicycle Plan and related plans and operations. Please come to the Morgantown Monongalia Metropolitan Planning Organization's Open House tonight 4-7 pm at the Public Safety Center (corner Spruce and Walnut). Examine the Bicycle Plan that the MPO has created for our area. Provide your input. The Open House will probably also be attended by WVDOH people and citizens of our area. Seeking Transporation Alternatives Application volunteers...

Bike Board Members, As of two days ago, we now have access to the WVDOH Grants Application page that will allow us to assist the City of Morgantown with preparing the Transportation Alternatives grant application for the Shared Lane Markings/Bikes May Use Full Lane signs and the Bike/Bus Shelter projects. I've attached a mostly incomplete application (*TA Application PDF 1289.pdf*) for your review. I've also attached a copy of the Letter of Intent (*TA Intent PDF 1289.pdf*) that was submitted by the City to provide you with the initial project descriptions. Please review the application and determine where your skills and expertise can help and let me know what sections you could complete or oversee. Please let me know by January 17th, so I can plan on who is doing what ASAP. The last day to submit our application is March 14, 2014. I'd like to finish it by the end of February.
