My understanding is that Mr. Donahue is seeking to remove liability for property owners who allow for trail easements in the University Town Center area. I was under the impression that there is a provision in the West Virginia Rails to Trails Program legislation (http://www.legis.state.wv.us/WVCODE/Code.cfm?chap=05b&art=1A#01A) that does this exact thing for lands that provide no-charge links to rail trails, §5B-1A-9. Limitation on liability of persons making land available for trail use without charge.
Why not connect to the rail trail, open up access to the west, and answer the liability question without additional legislative action?
